Welcome to StorageAndBoxSnapper! These Terms of Service ("Terms") govern your use of the StorageAndBoxSnapper mobile application (the "App") and the StorageAndBoxSnapper website at storageandboxsnapper.com (the "Website"), both operated by BVTechLabs ("we", "our", or "us"). By accessing or using our App or Website, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, accessing, or using the App or Website, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the App or Website.

2. Eligibility

You must be at least 13 years old to use the App or Website. If you are under 18, you represent that you have obtained permission from your parent or legal guardian to use the App and accept these Terms. By using the App, you represent and warrant that you meet this eligibility requirement.

3. Description of Service

StorageAndBoxSnapper is a home organization and inventory management application that allows you to:

  • Catalog and track household items across multiple homes, rooms, and storage spaces
  • Generate and scan QR codes for boxes and containers
  • Use AI-powered features (on Pro tier) to detect and describe items from photos
  • Create backups and export your inventory data
  • Organize items with tags, categories, and tasks
  • Access support resources and tutorials

The core functionality of the App works offline and stores data locally on your device. Certain features (AI analysis, cloud sync in future) require internet connectivity and may incur charges or use credits depending on your subscription tier.

4. User Accounts and Registration

Currently, the App does not require account creation. All data is stored locally on your device. However, we reserve the right to introduce user authentication and cloud-based features in the future. If we do:

  • You will be responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account
  • We reserve the right to suspend or terminate accounts that violate these Terms

5. Subscription Tiers and Payments

5.1 Free Tier (Standard)

The Standard tier is free to use and includes:

  • Core inventory management features
  • Local data storage
  • QR code generation and scanning
  • Advertising (displayed every 20 items added)

5.2 Ad-Free Tier ($1.99 one-time)

Removes all advertisements from the app. This is a one-time purchase with no recurring charges.

5.3 Pro Tier ($4.99 one-time)

Includes all Ad-Free features plus:

  • AI-powered item detection from photos
  • Voice transcription and translation
  • Bring-Your-Own-API-Key (BYOK) for OpenAI or Google Gemini
  • Advanced semantic search using your own API
  • No advertisements

This is a one-time purchase with no recurring charges. You provide and manage your own AI provider API keys. Usage of AI services (OpenAI, Google Gemini) is subject to their respective terms and pricing.

5.4 Credits Plan (Future)

We plan to introduce a Credits-based plan where:

  • You purchase credit packs to use our AI services without managing your own API keys
  • Credits are consumed for AI image analysis and voice transcription
  • Cloud sync and multi-device support may be included

Details, pricing, and terms for the Credits plan will be provided when it becomes available.

5.5 Payment Processing

All payments are processed through Google Play Billing. By making a purchase:

  • You agree to Google Play's terms and conditions
  • We do not store your payment information
  • Purchases are non-refundable except as required by law or Google Play's refund policy
  • You are responsible for all charges incurred under your Google Play account

6. AI Features and Third-Party Services

6.1 Pro Tier - Bring Your Own API Key (BYOK)

When using the Pro tier with BYOK:

  • You provide your own OpenAI or Google Gemini API key
  • Data (photos, voice recordings) is sent directly from your device to your chosen AI provider
  • We do not store your photos, recordings, or AI responses on our servers
  • You are responsible for costs incurred with your AI provider
  • Your use of AI services is subject to the provider's terms of service and privacy policy

6.2 Credits Plan (When Available)

When using the Credits plan:

  • Data may be routed through our servers to apply credits and usage tracking
  • We may cache or temporarily store data for processing but do not retain it long-term
  • Credits are consumed per AI request (details to be provided when launched)
  • Credits do not expire but are non-refundable

7. User Content and Data

7.1 Your Data

You retain all ownership rights to the data you create, upload, or store using the App ("User Content"), including:

  • Inventory data (homes, rooms, items, descriptions)
  • Photos and images
  • Voice recordings
  • Tags, categories, and custom metadata

7.2 Local Storage

Currently, all User Content is stored locally on your device. We do not have access to your data unless you explicitly share it with us (e.g., through support requests or backup uploads in future features).

7.3 Backups and Exports

You can create backups of your data at any time using the App's backup feature. Backup files are stored locally or where you choose to save them. You are responsible for securely storing and managing your backups.

7.4 Future Cloud Sync

We may introduce cloud sync and multi-device features in the future. If we do, we will update these Terms and notify you. Cloud-stored data will be subject to additional terms and our Privacy Policy.

8. Acceptable Use

You agree to use the App and Website only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the App to store, transmit, or share illegal, harmful, or inappropriate content
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Use the App to violate any applicable laws or regulations
  • Interfere with or disrupt the App, Website, or our servers
  • Use automated tools (bots, scrapers) to access the App or Website without permission
  • Impersonate any person or entity or misrepresent your affiliation
  • Share your API keys or subscription entitlements with others
  • Abuse or exploit the App's features (e.g., excessive AI requests, spamming)

We reserve the right to suspend or terminate your access to the App if you violate these acceptable use terms.

9. Intellectual Property

9.1 Our Rights

The App and Website, including all software, design, text, graphics, logos, and other content, are owned by BVTechLabs and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from our intellectual property without our written permission.

9.2 Trademarks

"StorageAndBoxSnapper" and associated logos are trademarks of BVTechLabs. You may not use our trademarks without prior written consent.

9.3 Open Source

The App may use open-source software components. Notices and licenses for these components are available within the App or upon request.

10. Disclaimers and Limitations of Liability

10.1 No Warranty

THE APP AND WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not guarantee that:

  • The App or Website will be error-free, uninterrupted, or secure
  • AI features will be accurate, complete, or reliable
  • Data stored on your device will not be lost or corrupted
  • Backups will be successfully created or restored

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BVTECHLABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP OR WEBSITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10.3 Third-Party Services

We are not responsible for the availability, accuracy, or content of third-party services such as OpenAI, Google Gemini, Google Play Billing, or Google AdMob. Your use of these services is subject to their respective terms and policies.

11. Indemnification

You agree to indemnify, defend, and hold harmless BVTechLabs, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the App or Website
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your User Content

12. Termination

We reserve the right to suspend or terminate your access to the App or Website at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Requests by law enforcement or government agencies
  • Discontinuation of the App or Website

Upon termination, your right to use the App and Website will immediately cease. You may still retain local data on your device, but access to cloud features (if available) may be revoked.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by:

  • Posting the new Terms on this page with an updated "Last Updated" date
  • Showing a notification in the App (for significant changes)

Your continued use of the App or Website after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the App and Website.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of South Africa, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the App or Website shall be subject to the exclusive jurisdiction of the courts located in Pretoria, Gauteng, South Africa.

14.2 Dispute Resolution

Before filing any legal action, you agree to attempt to resolve disputes informally by contacting us at the contact information provided below. If a dispute cannot be resolved within 30 days, either party may proceed with formal legal action.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BVTechLabs regarding the App and Website, and supersede all prior agreements.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign or transfer these Terms at any time without notice.
